Food and Palengke Terms of Use

The Services comprise a platform that presents you with a set of one or more retailer virtual storefronts from which you can select goods for picking, packing, and delivery by individual to your location or, if available, for you to pick up in-store. Picking, packing, or delivery services may be performed by third parties including a retailer or third party logistics provider (collectively, “Third Party Providers”).

Purchase

When you use the Services to place an order for products, you authorize the purchase and delivery of those products from the retailers you select. Unless otherwise specified, you acknowledge and agree that Kooryr and the “Preferred supplier” are acting as your agents in the picking, packing, and/or delivery of goods purchased by you and are not the seller of the goods to you.You agree that your purchase is being made from the retailer you have selected, that retailer is the merchant of record, and that title to any goods passes to you when they are purchased at the applicable retailer’s store. You agree that Kooryr or the applicable retailer will obtain a credit card authorization for your credit card on file with Kooryr to cover the cost of the goods you have purchased from the retailer and any separate Kooryr fees, and your card will be charged for the goods purchased by you and any applicable fees, taxes and/or tips.You also acknowledge and agree that, except as expressly provided for otherwise in these Terms or a separate agreement between you and Kooryr, Kooryr does not form any employment or agency relationship with you and does not hold title to any goods that you order through the Services.

Pricing and Payments

You understand that the prices for product or menu items displayed through the Platform may differ from the prices offered or published by Merchants for the same product or menu items and/or from prices available at other third-party websites/mobile applications. Prices for product or menu items displayed through the Platform may not be the lowest prices at which the product or menu items are sold.Because of the nature of the Platform, Kooryr does not always

know how much a Merchant will charge for a particular product or menu item. Where your cart includes product or menu items for which Kooryr does not know the exact price to be charged by the Merchant, Kooryr may designate an estimated subtotal for such product and menu items (the “Estimated Subtotal”). Similarly, where Kooryr does not know the exact price of certain or all fees associated with the order, including any applicable taxes and/or Kooryr fees, we may designate an estimate for such fees (the “Estimated Fees”). If you have included product or menu items in your cart that are subject to Estimated Subtotal and/or Estimated Fees, we will provide you with an estimated total. Merchants may charge more or less than the Estimated Subtotal for products or menu items you order. Similarly, we may charge more or less than the Estimated Fees based upon the final prevailing price of Merchant’s goods. In some cases, we may not be able to provide Estimated Subtotal or Estimated Fees, such as when the merchandise cost is unknown or we are otherwise unable to predict fees. Kooryr reserves the right to determine final prevailing pricing of all product or menu items ordered through the Platform. In cases in which prevailing pricing is different than the Estimated Subtotal and/or Estimated Fees, what you are ultimately charged may be different than the estimated total. You acknowledge and agree to pay the prevailing pricing and fees, even if they differ from the Estimated Subtotal and/or Estimated Fees.Unless otherwise indicated, all prices and other amounts are in the currency of the jurisdiction where the delivery takes place.Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions that may relate to pricing, product descriptions, promotions offers, and availability.Kooryr reserves the right to correct any errors, inaccuracies or omissions and to change or update information or refuse or cancel orders if any information on the Services is inaccurate at any time without prior notice (including after you have submitted your order and/or your credit card has been charged).Please note that prices of products on the Services may be different than prices offered for the same products in-store by the same retailer.The price to be paid by you shall be based on our prevailing selling price at the time we receive your order, which may or may not be correctly reflected on the Site or through our Services.If the actual price of any item ordered by you is higher than that reflected on the Site or through our Services, we will inform you and you will be given an option to confirm or cancel your purchase of such item based on the correct price.By confirming your purchase, you authorize us to charge the additional amounts to you. If you elect to cancel the purchase, we will reverse or refund payment for such item in accordance with our prevailing refund policy at such time. If we are unable to contact you, we will treat your order in respect of the incorrectly priced item as cancelled.Where the actual price of any product is dependent on its weight (“Weighed Item”), we will provide an estimate of the price based on indicated weight and our current prevailing rates at the time of checkout. The actual weight and related price of the Weighed Item will be made known to you at the time of delivery and:· in the event of any shortfall in payment, we reserve the right to charge you for the additional amounts; and· in the event of any overpayment, we will reverse or refund the excess amounts paid for such item in accordance with our prevailing refund policy at the time of delivery.Payment for all orders shall be made in Philippine pesos.

Returns, Replacements, Refunds, and Credits

Charges paid by you are final and non-refundable, and will be quoted in the local currency of the location where the order is being delivered or picked up, Kooryr has no obligation to provide refunds or credits. In the event of wrong orders delivered, Kooryr is responsible contacting merchant to inform situation. If by any instance that the direction or instruction is unclear, customer will not be eligible for a refund or cancel orders.You can make a claim for a refund or credit if:

  1. you believe that Goods we charged you for were not provided; or
  2. there is a fault or defect with the Goods you have purchased.

We’ll assess your claim and are happy to offer a credit or refund for any missing or faulty Goods.For standard home deliveries, Kooryr won’t pick up any Goods that you don’t accept. However we may need to inspect the Goods before making an assessment, therefore please keep them until we advise they can be discarded.You are deemed to have accepted the goods upon delivery at the Delivery Address. If you wish to dispute the contents of the delivery please inform our transporter immediately upon receiving items/food/consumable products. If the transporter has left your location without receiving complains, we will not entertain any further complains.

24-hour cancellation policy

If you cancel your order, you may be charged depending on what stage the order was in when you cancelled.
